If you can register with a birthdate and then change it this effectively changes the necessity of the field to zero. As far as gambling for real money and being of legal age this could easily be done by a checkbox stating "By clicking on this box I admit I'm old enough to gamble for real money. Harsh penalties including decapitation, drawing and quartering, wedgies and termination of your account will apply if we find out you lied."
Alas this field only gives Chippie Cheese birthday promo scammers a chance to keep getting a piece of free cake virtually every day of the year.
